1. PARTIES AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF CONTRACT:

On the one hand, the supplier of the products, Mood Estudio de belleza S.C.P. (hereinafter also the provider), with registered office at Avd. Pintor Felo Monzón nº19, Local 4, 35019 Las Palmas de Gran Canaria, (Las Palmas), N.I.F. J06981344, customer service telephone 605704955, and GMAIL: oryaestudiobelleza@…, being the owner of the website www.oryaestudiobelleza.com, sets forth the contractual document that will govern the contracting of products through the aforementioned website.

And on the other hand, the User – Client (hereinafter the User), registered on the website through a username and password, for which he/she has full responsibility of use and custody, being responsible for the veracity of the personal data provided to the provider.

BOTH AGREE to the present document, and it entails that the user:

a. You have read, understand and comprehend the above.

b. That he/she is a person of legal age and with sufficient capacity to contract.

c. That he/she assumes all the obligations set forth herein.

d. That you have read and accept the present general conditions of purchase from the moment you purchase any product offered.

Mood Estudio de belleza S.C.P. is a company specialized in the distance selling of beauty products specialized in the eyes. Mood Estudio de belleza S.C.P. has a physical store in Avd. Pintor Felo Monzón nº 19, Local 4, 35019, Las Palmas de Gran Canaria for the sale of its products.

2. OBJECT OF THE CONTRACT:

2.1 Scope of application: The purpose of this contract is to regulate the contractual relationship of purchase and sale born between the Provider and the User at the time the User accepts these Terms and Conditions of Purchase. These GTC shall apply from the day the order is placed.

2.2 Territory of application: The online store of www.oryaestudiobelleza.com is active for the entire world.

2.3 Capacity to contract: In order to place an order you must be of legal age and have the capacity to contract.

2.4 Acceptance by the customer: The validation of an order through the website www.oryaestudiobelleza.com is done by email and also implies automatic acceptance of the GTC.

2.5. Modification of the General Terms and Conditions: Mood Estudio de belleza S.C.P. reserves the right to make changes and/or modifications to these Terms and Conditions. We advise our clients to review them regularly. In the event that these changes or modifications are introduced after an order has been placed, the conditions in force on the date on which the order was placed will apply.

3. INFORMATION PROVIDED ON THE WEBSITE www.oryaestudiobelleza.com:

3.1 Publication of prices: The prices of the products are those shown for each product on our website www.oryaestudiobelleza.com.

3.2 Product information: The contents of www.oryaestudiobelleza.com are constantly being renewed and updated to offer our customers the most complete and detailed information possible. All information on www.oryaestudiobelleza.com is shown in Spanish (Castilian).

3.3 Right of Cancellation: Mood Estudio de belleza S.C.P. reserves this action (right of cancellation) of the delivery of a specific product that does not meet the quality requirements imposed on all products of www.oryaestudiobelleza.com. In the event that this lack of quality is detected, Mood Estudio de belleza S.C.P. Customer Service will suggest a replacement product and, if the replacement is not to the client’s liking, the cost of the product will be refunded.

3.4 Orders 24 hours a day, every day of the year: The schedule of reception of orders is twenty-four (24) hours the three hundred and sixty-five (365) days of the year, although orders placed after twenty (20:00) hours will not be processed, remaining for the next business day in Las Palmas de Gran Canaria. Orders received on Friday will be processed to arrive on Monday or the first following working day, and those received on Saturday until 10:00 a.m. will be delivered on Monday (or the first following working day). However, from Canary Islands to Peninsula the average delivery time is 5-7 days.

3.5 Fraud: If Mood Estudio de belleza S.C.P. suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.

4. PURCHASE PROCEDURE:

In order to access the products offered by the provider, the user must register through the website by creating a user account.

Once the user account has been created, we inform you that in accordance with the requirements of art. 27 of Law 34/2002 of Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:

1.Choose the product by clicking on it, and it will be automatically added to the “shopping cart”.

Express shipping charges will be applied as follows:

For orders over or equal to 100 € in products, the shipping cost will be as follows.

5.3 Shipping address: a. Orders will be delivered to the delivery address designated by the user. The provider assumes no responsibility for when the delivery of the product does not take place as a result of false, inaccurate or incomplete data provided by the user or when the delivery cannot be made for reasons beyond the control of the shipping company assigned for this purpose, such as the absence of the recipient.

When the purchase is made, the place of shipment and/or pick-up is chosen.

5.4 Delivery time: The delivery time is usually between 24/48h in express parcel and 48-72h. It may vary if it is a shipment to mainland Spain, Portugal, Balearic Islands and international, either in standard or express parcels and depending on the payment method chosen.

5.5 Confirmation of shipment: Upon delivery of the order to our carrier we will send you confirmation of shipment to the e-mail address you provided when placing the order.

6. PRICES AND TERMS OF VALIDITY OF THE OFFERS:

All prices shown in the store www.oryaestudiobelleza.com include the I.G.I.C. in force at the time of purchase. All prices shown on the website are expressed in Euro currency (€). These costs do not include shipping costs, handling, packaging, shipping insurance or any other additional services and annexes to the product or service purchased.

In the case of limited duration promotions, the promotion discount will be applied as long as the order has been registered during the promotion period.

7. FORMS OF PAYMENT:

The available systems are listed below:

7.1 Payment by credit or debit card: The user must have a valid credit or debit card, where you must specify all digits of the card number in the appropriate form. The operation is formalized at the moment of placing the order. Only Visa and Mastercard are accepted.

7.2 Payment by transfer or deposit to account: At the time of finalizing the order the user will receive instructions with the account number to pay the order. Once the payment has been made correctly, your order will be finalized and an email will be sent with the summary of your purchase. By clicking on the “Back to website” button you will return to the website to view and print your order.

8. RIGHT OF WITHDRAWAL:

8.1 Right of withdrawal: The user has the right to exercise the right of withdrawal, and for this purpose has a period of 14 calendar days from receipt of the product; the consumer must be reimbursed the full amount of the purchase, ie the price of the product, within 14 days after the exercise of the right of withdrawal by the user / consumer. You must return the product with all the elements with which it was delivered, without damage or marks of wear of any kind, and that does not denote an improper use of the good or different from the nature of the same to the address we have provided.

It is advisable to return the product in its original packaging, in case it is not possible, the product could suffer a depreciation in its value. The customer will be responsible for the packaging and protection of the product(s) sent as well as the shipping costs.

Provided that the products are returned within 14 calendar days, without any damage or marks of wear and tear and complying with the requirements set forth in this section, we will refund the full amount of the purchase.

8.2. Return due to an error in the order by Mood Estudio de belleza S.C.P.: When the product does not correspond to the one ordered, due to an error attributable to the company, the user must notify the company by e-mail as soon as possible; Mood Estudio de belleza S.C.P. will bear the cost of collecting the product sent in error and delivering the product corresponding to the one ordered.

8.3 Verification of Returns: The verification and checking of the products being returned will be the responsibility of Mood Estudio de belleza S.C.P. In the event that any of the items are missing, we would communicate to you in writing via email indicating the missing content.

9. APPLICABLE LAW AND JURISDICTION:

These conditions shall be governed by or construed in accordance with Spanish law in that which is not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of products or services covered by these Conditions, to the Courts and Tribunals of Las Palmas de Gran Canaria.
